SEC Extends 151A Comment Period
 
The Securities and Exchange Commission (SEC) has extended its comment period for proposed Rule 151A. Originally set for Sept. 10, the deadline was contested by many industry players and Congress people, who wrote to the SEC requesting an extension. At the time, that extension was not granted, though an SEC spokesman said the Commission would continue to take into consideration any letters that came in during their review process.

The SEC has announced the new comment period will end 30 days from the notice’s publication in the Federal Register. Kim O’Brien, executive director of the National Association for Fixed Annuities (NAFA), said that publication will likely be made the week of Oct. 20.

A release by the Commission indicated their decision was made primarily on the basis of the feedback they received.

“The Commission has received numerous letters, including from state insurance commissioners, members of Congress, and others, requesting that the comment period be extended,” the release read. “In general, these commenters indicated that an extension would help them analyze the proposal and prepare meaningful comments. In order to provide additional time for the public to thoroughly consider the proposal, and in view of the significant continuing public interest in the proposal, the Commission believes that it is appropriate to reopen the comment period.”

NAFA has said they will use the additional time to complete an economic interest analysis and obtain a statement of authority on the analysis from an independent third party.

Those wishing to comment on the proposed rule, which would reclassify index annuities as securities, may do so in several ways:

  • Use the Commission’s Internet submission form at www.sec.gov/rules/proposed.shtml
  • Send an email to rule-comments@sec.gov This e-mail address is being protected from spambots. You need JavaScript enabled to view it (include “File No. S7-14-08” in the subject line)
  • Use the Federal eRulemaking Portal (www.regulations.gov), following the instructions for submitting comments
  • Send paper comments in triplicate to Florence E. Harmon, Acting Secretary, Securities and Exchange Commission, 100 F Street NE, Washington, DC 20549-1090

All comments should refer to File No. S7-14-08. The Commission has asked commenters to use only one method in order to help them process comments more efficiently.
